We’ve seen this before. So, is the Sotomayor pick just the Democratic version of the “let me propose the more radical candidate first, with the assumption that s/he will be shot down, then follow up with a less radical, yet still liberal judge so that any complaints from Republicans will appear whiny to the public and therefore s/he will be confirmed” tactic? I think so. What scares me is that judges are supposed to interpret laws, not make them. Sotomayor thinks differently. She believes that judges DO create policy, hear her say this in her own words:
